A KwaZulu-Natal High Court judge has rejected charges against a former Queensland VFL player charged with rape.
Anthony O’Brien was jailed for four months at The Parramatta Magistrates Court after pleading guilty to three counts of rape and one count of criminal force without violence to his victim in March.
But the court heard that one of the other two counts of r우리카지노ape and one of forcible entry were dismissed on appeal.
The 31-year-old was r바카라emanded in custody to appear at Parramatta Magistrates Court on February 23.
The woman’s father, former rugby league star Ben O’Brien, described his son as a “nice, kind guy”.
Justice Paul Martin told Mr O’Brien that he should not be allowed to contact his son after the incident.
“He has said that he won’t,” he said.
“You have the honour of having served the community and have done so for many y바카라사이트ears.”
When Mr O’Brien’s team-mates returned from a match in Germany this summer, he did not visit them at the Magistrates Court and is thought to have not yet met them, Justice Martin said.
Mr O’Brien also did not attend the sentencing hearing earlier today.
Lawyer Michaela Fauchia told the court the court had failed to get a fair sentencing, and that O’Brien could have been eligible for the community service in the event of the hearing being called off.
She said her client’s rehabilitation had continued despite what her client described as an “unbearable amount” of abuse.
“The Court found that the circumstances did not warrant that O’Brien would be punished in such an excruciating manner for a crime he did not commit,” Justice Martin said.
O’Brien was one of two former KVFL players on trial last month charged with rape and sexual assault.
Judge Martin said he would not be calling any trial date this week, but it could be held when O’Brien makes an appearance in Parramatta.
